Frespar BV

Terms of sale

1. Seller and customer

The seller is Frespar BV, Gotegemstraat 27, 9450 Haaltert, Belgium, VAT/KBO BE 1001.359.209, info@frespar.be, 02 883 92 18 ("Frespar"). The customer is any private individual or business that chooses a tree from The Twenty-One. These terms apply to every offer, choice and sale.

2. Price

Each tree costs 999,- including VAT. The price includes delivery to your door and a Cinco C150 Advantage stand. A manifestly incorrect price, such as a typographical error, does not bind Frespar.

3. Choosing and confirmation

You choose a tree on the website, with no payment. Frespar confirms your choice personally within 48 hours. The sale is final once Frespar has confirmed it, and Frespar then sends the invoice.

4. Payment

Frespar sends the invoice itself. It must be paid in full before delivery, by bank transfer to the account stated on the invoice. If it is not paid in time, the tree is not delivered and Frespar may cancel the sale.

For private customers, a free reminder is sent first. Any late-payment interest and costs stay within the limits of Belgian consumer law. For businesses, the law of 2 August 2002 on late payment applies.

5. Cancellation

You can cancel free of charge until 15 November, by email to info@frespar.be. Anything already paid is refunded within 14 days.

After 15 November, your tree is cut and prepared for you alone, so the sale can no longer be cancelled.

Cut Christmas trees are a perishable natural product. Your tree is only cut and prepared for you after you choose it, in the last week of November. The legal 14-day right of withdrawal therefore does not apply (Belgian Code of Economic Law, art. VI.53, 3° and 4°). The free cancellation until 15 November replaces it.

6. Delivery

Delivery is to your door, between 1 and 15 December, on the agreed day, in Belgium, the Netherlands, Luxembourg, Germany, France, Austria and Switzerland. Placement inside the home is not included. Swiss import duties and VAT are paid by the customer. The risk passes to you once the tree has been delivered.

If nobody is home, the tree is left at your door, with its stand. From then on, the tree is your responsibility.

7. Conformity and guarantee

Your chosen tree stays your tree. The photos are taken in October. By delivery, the tree may still change slightly through natural growth and the weather. Small differences from the photo are normal for a living tree.

Please check your tree on delivery and report any visible problem within 48 hours, with a photo, to info@frespar.be. This does not affect the legal guarantee that private customers have under Belgian law. A tree is a living product: natural differences in shape and colour are not defects.

8. Liability

Frespar is not liable for indirect damage, or for damage caused by improper use or care of the tree. Nothing in these terms limits liability for fraud, wilful misconduct or gross negligence, or the rights that private customers have under the law.

9. Retention of ownership

The tree remains the property of Frespar until the full price has been paid.

10. Personal data

Frespar uses your details (name, email, city and message) only to handle your choice, delivery and invoice, and to contact you about it. You may view, correct or remove your details at any time through info@frespar.be. See also the cookie statement.

Full details are in the privacy statement.

11. Law and disputes

Belgian law applies. Disputes are subject to the jurisdiction of the courts of the district where Frespar has its registered office. Private customers may always go to the court of their own place of residence, and they keep the protection of the law of their country.

Private customers can also contact the Belgian Consumer Ombudsman (consumentenombudsdienst.be).
